Transfer of Gaurdianship

What is the name of your state? Manitoba (In Canada)

I have a question for you all. I have had legal gaurdianship of my Niece for the past 2 years. She will be 4 soon and was placed with us by child welfare authorities when she was 1 so we've had her for 3 years total. She is very bonded to my wife and our kids. She has taken to calling us mom and dad and our kids brother and sister.

Her bio mother is now saying she is clean from drugs for the past 7 months. (She was addicted to serious drugs for the past 4 years, including while pregant with my niece) She has had another child and now that we have announced our goal of maintaining the child in our home and adopting her to provide her with stability she has decided to take us to court to try to get custody back. She did agree in court 2 years ago to the child welfare agency transfering gaurdianship over to us.

My question/Concern is would a judge uproot a small child and place her in an uncertain situation when she is so well settled where she is? Do you guys think the bio mom has a chance? We have always stated and continue to say that we feel it is important to maintain a relationship between daughter and bio parents and have been having visits with parents weekly. They feel they should have more access and we feel she needs to feel stable and can't if she's gone from our home four-five days a week. Just looking for other opinions and advice.

Unfortunately this forum is for US Law ONLY~ So it won't be possible to answer your question re; another countries law about child custody and welfare.

Try google and type in Canadian Child Custody Law or some such.

I hope for the best in this situation.
