I recently won a judgement in a small claims suit. The defendent didn't show up. A month later I recieved a "set aside" from his lawyer stating that he didn't get the notice to appear. Here is what i want to do: Allow him to win the "set aside", Then have the case refiled in regular court. That way I can use his motion against him because he actually owes me more than the $3500 small claim limit and his hiring of a lawyer would have been a waste. Legally, will this work? I would probably hire a lawyer to take care of it for me. Is this a stupid idea? I live in Connecticut.
