I own a duplex, which was rented out to two different families. Both use to pay on time until recently. On one side they owe $1200, the other side $1900. The one that owe the $1900 lease had expired in September. I ask if they wanted to renew in September, but they told me they was going to move. Well the move never did happen. They give me the run around about paying the rent, or never answer the door when I go around there. I meet up with this tenant 2 days ago to ask what was her plans, again she smiled in my face and said oh i'm moving. 5 months she hasn't paid, and i want her out like yesterday. The other tenant's story is about the same. Seems as though they had form a buddy - buddy system, and can live for free. Please help me. oh and yes I did do an eviction before, but the guy that took my money for this process ran off with the money. I found the right place to go to now, but Is there any fast, instant result that can be done. What about the tenant whose lease had expired. They are killing me. I would much rather perfer to get rid of both as soon as possible. They are too far behind in rent, and I don't expect them to pay they been riding on me for much to long. Please help me out. This is not good business.

OH come on YOU are a real DUMB landlord...sell the house you are NOT cut out for this kind of work!

You have to hire a REAL landlord/tenant lawyer and start eviction proceedings TOMORROW, Then let the lawyer do all the work, thats what you are paying him for.

and dont tell me you aint got no money....

Do NOT go to work tomorrow, hire a lawyer, and get them out it will take a couple of weeks, but if you get a judgment agaist them, it will be on their credit report, and you can get a Marshal to go after anything they own to pay you, or garnish their wages....

LAWYERS are a TAX DEDUCTABLE expense against any income you report to the IRS

Just who did you give money to? Unbelivable!

Someone referred me to this guy. The business look very ligitimate. It was a landlord assistance type center. I am young and I thought this would be a very good start for me in life. I went in without knowledge of renting, faith and added help from older friends. I brought this place with saved money, put it together from what looked liked hell before, everything new, and all I asked for was reasonable rent monthly. No one deserves to be treated like this. No one lives for free unless you are homeless. These people really did a number on me, and yet remains as if I owe them something. Can you be a little nicer. had I had known I wouldn't be writing to you. I really need your advice/your help. Thanks you soo much!!

Well I got you attention......Hire a lawyer today!

Read the landlord /tenant laws of your state, and get to work on this,

You must make a profit on your rental, at least $100-200 a month per apartment, to cover extra costs, and have 2 or 3 months of rent.. in the rental bank account so this stuff wont happen.

You have a day job, it comes with benefits, such as vacation, sick and personal days....well USE THEM.

So did you hire a real Lawyer yet?

I found this......print it out and start reading. It says 1995 but you will get the idea, and a lawyer will know of any recent changes to the law. especially 83.56 you could have given them a 3 DAY notice to pay or you could start evcition proceedings!

Also read 83.625 NO money judgement can be made unless they are personally served with eviction papers...so the lawyer must hire a profession licensed process server,to get it done right. That means if they vacate and dissapear in the middle of the night or move to another city are not personally served with eviction papers, then all you get is possession, but no back monies.

This is still America and they do have a right to appear in court and defend themselves.

He could hire someone to serve them in another city, but thats more expensive, but concidering what they owe you, it would be worth it.

I really do appreciate this, because like I said, I went into this thinking that it would be a good investment down the line. Jan. 16th I will file all necessary paper work. The tenants are very rude, they uses profanity when I come around telling me to get off their property, the nerve of them. I am a christian and I try not to let evil get the best of me. But there are some things you just cannot do and expect nothing to happen. You cannot expect to live in someone's property and pay nothing. I started to have the water shut off, but someone told me I can't do that, that I would be in the wrong. seems to me that tenants have all the rights. Again any information at this time, about this situation would be very appreciative. please feel free to

Right YOU CANNOT turn off utilites, or they can sue you...no kidding, but the electric phone or water company can if its in their name.

No tenants do not have all the rights, but it does work both ways, YOU have to honor the lease just like the tenants.

YOU expect them to pay rent on time, and they EXPECT YOU to fix things quickly. that sounds fair to me.

Good luck, and dont worry about being christian, you have to get even with them and recoup your losses......If you still feel bad after runing their credit and garnishing their wages, then give it to the church.

Thanks soo much, you really added a smile to my face. Just wish me good luck. Who knows, maybe income tax will hit me twice this year. I think my family deserves it. Thanks again. Feel free to post any new info.
