Transfering funds FOREX

I use to have a FOREX account (FXCM) in March 07 i asked for a refund (1000USD) and they immediately took out the money from my forex account. Then , they told me that I had to wait up to 5 business days to receive that money into my checking account, ...well, I haven't received the founds yet. I have tons of mails from them saying that it is not their problem, that I should contact my bank, and I did but they have told me that they are just the receivers and they do not have any information about those funds... and I think they are right, if something happens the sender (forex) should be responsible for that. The 3rd party they've used to transfer the funds is Bank of America (my checking account is from BANAMEX) but i do not have contact with BA..just with forex....to me they have stolen my money from my forex account because i dont see the money in my checking account either
This situation has caused me interests and personal problems since i was supposed to receive those funds.
Is there any way I can sue them?
