I live in OH. I understand that I am allowed to trim the branches of trees that overhang our property. However, the link I would like to cut back is 30-40 feet in the air! A cherry picker cannot be brought in due to space limitations. The only means to trim the limb would be to go on the other property, climb the tree and cut the limb. The property has No Tresspassing signs every 10 feet. I've talked to the owner about having someone climb the tree to prune the branches and he stated that the tree company would not be permitted on the property. Do I have any legal recourse? I planted a garden on my property and the limb is shading the sun. In addition the limb is quite large and could do considerable damage if the limb fell during a storm.

Could I sue for the court costs as well. I plan on telling the property owner that I will take them to court to see if that changes his mind. Not a threat, but a fact. Can this be handled in small claims court? Can I include court costs? Not trying to get the money for the actual pruning, just the right to access the property any any cost involved with having to go to court to get said permission, ie, vacation time will have to be used.
