Ohio law question
I have a tree on the property line. About 50 inches diameter. 80% of it is in the neighbor's yard. The tree almost dead, and may fall on our house. Who is responsible for the cost of cutting it out? We have a friendly relationship, we can share the cost but i would like to know what the law says.

Here in Cali...

Here in CA and in my town, we are not allowed to remove any trees above a certain circumference without express permission from the city, even though we may have planted it in prior years. I called my insurance company and asked their advice. They said no problem...if it falls on our house it will be paid by my own insurance company. Don't know if it is similar for your state.

Check with your city's code enforcement office or planning (and planting) department and get their advice. They may contact the other homeowner involved for you.

Typically....

....if a tree is a demonstrable hazard, then it is the owner's responsibility to remove it. You'd need a tree expert's opinion (to prove it is actually a threat) as well as a certified letter to the owner.

Since you get along with the neighbor, eventhough you're probably legally within your right to demand he remove the hazardous tree, splitting the cost is a good idea. Congenial neighbors are priceless.
