my nieghbor's tree hangs over my fence and pool area dropping leaves, etc. into my pool. Is it their responsibility to trim the tree back to the property line?

I think laws regarding responsibility for overhanging trees varies with location. So you should check with a local attorney. In California, you would be permitted to cut the branches at the property line. And, you might be able to hold your neighbor responsible for any costs associated with the droppings from the trees. Sometimes local mediation services can assist neighbors in working out problems such as these. Check the phone book under mediation.

In other states, any part of the tree hanging over the property line belongs to you. You can cut off any part of the tree that crosses over, all the way up.

The neighbor can't come onto your property to trim a tree that legally belongs to you without subjecting himself to large damages (usually triple damages).
