Tree triming in california

I have a tree that is on my property, this tree grows over the fence. my neighobors Have stated to me that he wants me too cut the tree to the fence line and mantain it there, and has stated that he'll take me too court If i Don't. Can he make me trim the tree that is not over grown,or desiaed.,he just wants too trim the tree because he put in spa under tree. tree has beeen here for longer then both of us.

My response:

Generally, in California, overhanging tree limbs, branches, or leafs that grow over or fall into your neighbor's backyard is the responsibility of the neighbor. That is, your neighbor, if he wants, can trim the overhanging flora up to the property or fence line.

I said "generally" because you didn't say what town or city you lived in. Some municipalities have "special" municipal codes concerning tree trimming, even if the trees are on private property. So, before trimming, you had better check with your City Hall to determine if there are any municipal codes or permit requirements before you start the old buzz saw.
