What is the name of your state? California
I allowed my daughter to move into my rear unit of a duplex last week when she fell on hard times.Since then she has been a real disapointment and we're not getting along.I asked her to vacate the property, she called the sheriff and said I was harassing her.He told me I can't just kick her out I need to evict her even thou I'm not charging her rent.
I'm the owner and I lost control of my property to my out of control daughter.
Is that correct?I need to go thru an eviction to get her out?

It's hard to believe that you extended a helping hand to your daughter, and all of a sudden she became "a real disappointment" and "out of control."

Seems like there should be more than just your daughter telling the sheriff that you were "hassling" her.

I'd look up any tenant/landlord groups in the area for their feedback or call the bar association about any attorneys who do pro bono (free) work. I suspect, though, that you might have to go to court and evict her.

If she's only been there for a week, there's no written agreement, and she's not paying rent, then she's not a tenant, she's a guest, I would think. But consult a lawyer in your area for further information.

**A: the sheriff is correct. Read the CA L/T law. Daughter is a m/m tenant on an oral lease.

My daughter and I had a falling out a few years back and we haven't even talked for a couple years. i actually sold her my parents house at a discount after they died and 2 years later she had to sell it since see quit making payments,She's was married with 2 kids.
Now she calls me says she needs help and want to straighten out her life,she just got out of 3 days in jail of Pot,driving,no insurance and also I gave her lawyer $2500 to help her out.
It took about 3 days and she couldn't do it,back to being disrespectful,smoking cigs and pot in the house etc.
Now I want her out and my back house and money back for lawyer but the lawyer won't return my call and she ready to send me to jail if I look at her wrong.:mad:
