I was tripped by another patron who swung her legs out while sitting on a bar stool as I was leaving the bar. Her seat was near the exit, and her legs caught me across the shins, and I went flying face first through the doorway and broke my shoulder. The bar has a capacity of about 163 people, and there were over two hundred people in the bar, and the seating extends partially into the exit aisle. Is there a case? This occurred about 9:00 PM on June 1, and I had 4 beers before we left. (I live in AZ)

My response:

I don't see the nexus (the relationship) between the overcrowded conditions and the fact that someone swung their leg out and accidentally tripped you. Unless you can show a nexus, this accident could have happened with 50 or 300 people in the bar.

You "might" have a case against the other person, but I don't see a Cause of Action against the bar itself, unless you can show some sort of "defective condition" of the seats; e.g., the seats are placed in such a fashion that it would be reasonable to expect people would trip other people when using the seats in a manner the bar owner intended.
