Because my wife's ex-husband's health, he was ordered in their divorce decree to maintain his current life insurance policy in an amount that will insurance that his former spouse be paid any and all unpaid child support owed or that would have been paid in the future by him at the time of his demise. The policy of insurance shall name the parties' minor children as irrevocable beneficiaries.

The ex-husband died June 30, 2002 and sometime prior to his death, he changed his life insurance beneficiary to his trustee. My wife's daughter is 13 and there still is $22,500 in future child support that should be paid. The trustee immediately stopped paying the monthly child support and will not pay the insurance amount to my wife. Fortunately, she put a claim against the insrance immediately after his death so the insurance company will not release the funds to the trust either.

Since he obviously went against the court ordered decree, we are wondering what steps we need to take to get this child support money.

Thanks for your ideas
