This will be quite lengthy.
Me and my husband moved into our current apartment on 8/25/09. We paid first and last month's rent, plus deposit and other fees. Some of these fees were made off in payments as per an agreement with our landlord. We also received October's month rent-free. Everything was fine, or so we thought....
It started a couple months ago when my husband was in the hospital for nearly a month. He is Army so it wasn't like we had no income coming in. There was an issue that our landlord had lost our water/sewer payment of $55 (or never received it, I still don't know but I know that he paid it). Now, up until this point we hadn't keep our money order stubs because we never thought there was an issue. Now, the landlord knew that he was at the hospital but because he is a nurse, she thought he was just at work for the day and couldn't make it in to pay it. So a couple days later, we get a notice and I end up paying the $55 again.
All is fine....for a couple weeks. We start receiving notices that she says are "policy" to send out no matter what (late rent, partial payment, etc) of a 3 day eviction notice. I had paid it already so I paid no attention to it. Well, they started accumulating. And they were for different amounts, amounts that to this day she can never tell us (or doesn't know) what the are for, that they are "just in the ledger".
After receiving about one notice a month, sometimes $40 for power (which was never switched to our name, forcing the apartment company to pay it and then us repaying them) and sometimes $100. One of the most recent ones was for $104.xx and was "supposedly" LMR for October. Well, as I stated, we were entitled to October's rent free. So we had no idea where this was coming from. We even got a copy of the ledger and it shows that we were actually $605 over, which I'm assuming accounts for paying Last Month's Rent when we moved it. (Our rent is $710 + $55 for water/sewage).
She then sent us a letter and notice that she had been trying to contact us and that we weren't returning her calls. On top of that, there was - what a shock - another notice for the $104 PLUS the power bill. This was the week leading up to Thanksgiving. The funny thing is, we tried calling her every single day (sometimes twice a day). Her assistant would either take a message, tell us that she would be back in 15 minutes (and it was always 15 minutes) or we would leave a voicemail. Our calls were never returned and she only contacts us if she's giving us another eviction notice.
About a week ago, she told my husband that they had calculated something wrong and that it was actually $40 instead of $100. Ok, I can live with $40. No big deal. Until this last week....We paid our rent a day late on 12/4/09 (there was no way to get it in on time, me and my husband have been planning the hospital's holiday ball for 12 hours a day for 2 straight weeks). We accepted the fact that there would be a $100 late fee. We got yet another notice for the $100, an addition $100 (which was supposed to be $40), the $710 for rent and $55 for water/sewage. I ignored the $865 (because we had already paid that....she sent out the notice first thing in the morning, I can understand). The notice stated that we had 10 days (12/14/09) to pay, or they would be entering our home on 12/17/09. My husband gets paid on the 14th, so we figured we could pay whatever it was we owed on that date (even if we don't know what it's for, really). I then receive another notice on 12/7/09 for a 3-day eviction notice for unpaid money (the same amount that was on the first notice) and that they would be entering our home on 12/9/09.
Now my question is, does the notice on the 7th void the one on the 4th? For some reason, and I'm not a lawyer, I would think that the 10 days would still be in affect, especially if it's the same notice essentially. I feel very upset and aggravated. So we called her (and she was actually in the office, it's amazing) and she said she would have to enter our home to see if we were still living there. This was before I pulled out the first notice and realized it was 10 days and for the same amount of money. The kicker is she never even showed up. I purposely waited around all day because I don't feel comfortable with other people being in my home. It wasted my whole day and I am a student. Maybe she thinks/knows she's in the wrong?
Also, how do I file a complaint against her? She is very young and seems like she doesn't know what she's doing and has a lack of experience. Not only do I think her bookkeeping and organizational skills are shoddy, but she is never in the office to deal with tenant concerns and questions.
