What is the name of your state? Minnesota

aunt state is California

I live in Minnesota and my aunt died in California. I have been notified I am an heir, which is set up for me in trust. My concern is having someone in CA as trustee while i am in MN and someone unfamiliar being in control of it for 10 years. Also the trust adjusts if someone mentioned in the will dies before distribution. I cannot confirm the existance of this person. The lawyer out there says he has no idea who the person is they only sent notification to the last available address. Do I need a lawyer? thank you for your help, lostluv

So who notified you that you were an heir--was it a court or a trust attorney or "the lawyer out there" that you mentioned? That is the person you need to contact to try to get more information, if possible and you need to find out if you are named as a beneficiary in the trust only, or if there is a will that may also name you as a beneficiary, although normally if a trust exists, most or all of the assets are put into the trust.

You need to find out who the trustee is and request a copy of the trust from the trustee, plus an accounting statement (which you are entitled to receive annually) showing the value of the trust.

Just because you are not familiar with the other person named in the trust does not necessarily mean anything. That may be a person known by your aunt whom she wanted to leave a bequest to. If you have suspicions about this person's motives, then hire a private investigator to have a background check done.

At this point you do not need the services of an attorney, unless there is something about the trust that you don't understand. All you have to do is sit back and wait to receive your check, you lucky person you!!

I was notified by the attorney handling the estate encouraged by the executor. I believe my aunt had everything placed in the trust but i will certainly ask when i am in CA this month. I am meeting the executor whom has been a dear friend of my aunt whom i trust. I did talk to the attorney and he had no other information as to the wareabouts of this particular person. I have no doubt that it is a valid person being left this money, I just dont know if the woman is alive or not, to which the portion of the trust left her would be adjusted because i am named next in line for her share if she is deceased or dies before disbursement.
