My husband filed for Chapter 7 in Jan. 2004 due to credit card bills of $75,000. These are his cards alone, he did this without my knowledge, and I did not benefit in any way. His 341 mtg. was in March. As of the end of July, his lawyer and the trustee are still exchanging letters since the trustee can't seem to get his facts straight. My husband just received notice of a motion to dismiss because the trustee states that he spends $900/month on recreation! Schedule J clearly states that it is only $100/month on recreation. The trustee over the past several months has gotten his salary wrong, his payroll deductions wrong, and is pressuring me to help with these bills. Everthing is owned in both our names, so he has no assets of his own. As of this date, my husband has spent $4,000 to his lawyer to straigten out this trustee and now he is going to spend more so the lawyer can send another letter correcting the recreation expense. My husband has no more funds. How can a trustee be so confused for so long and seemingly not even pay attention to the schedules nor the letters from my husbands's lawyer? What do you do when you have no more available funds in this situation?
