after finding out my husband had an affair we decided that we need to seek counseling before just getting divorced because we have an 11month old son. we are struggling with money as it is and it will be very hard to afford, so my question is do i have any legal right to sue the woman which whom the affair was with for half of the counseling fees? angry from new york

NY:When you talk about suing "the other woman" you are referring to a legal claim for "alienation of affection" damages. At one time in New York State there was a section of the law known as "heart balm statutes," which included this type of lawuit. Since these statutes were long ago abandoned, there is no legal recourse against the person who breaks up a marriage here in NY.
