I apologize in advance for the long post, I am just so frustrated...
Hello, I am trying to figure out my next step to take. On October 11, 2024, on my way home from work I was in a car accident with and 18 wheeler. I personally wasn't injured but my car was damaged on the quarter panel and the Insurance company is going to total a 2012 Ford Focus, with 85,000 miles on it in very good condition. Their your driver, hit my standing vehicle , while I was in the turning lane waiting to make a left turn. He made a right hand turn, which he obviously didn't have enough clearance for. After he hit me he kept going, a yellow school bus driver witnessed the accident and proceeded to catch up with him, while blowing their horn to let him know that he had hit me. So then he stopped. It looked like he was waiting for me. I proceeded to drive towards him and he took off again. I was three cars behind but I kept following him until he noticed I was behind him. He pulled over, the first thing he asked me was, "Are you the person I hit"??? Then he asked if I was hurt. He was very pleasant and said he didn't know that he hit me. I called the police, the police officer said since no one was physically hurt, they don't come out, just exchange information and we were free to go. We did just that, after we took pictures of the damage that was caused. I called my insurance company when I got home and filed a claim. On Monday, morning the company's insurance adjuster contacted me for a report, she called me back later the same day and said they were accepting blame and she would get me in contact with a collision center to get an estimate for repair. About two weeks later, on October 29, 2024 I finally take my car to their collision shop, and I was given a rental. The next day at 9am, the collision place called me and said that car cost too much to fix, and the insurance company would total it out and give me the blue book value for it. I told her that my car was still drivable, nothing was wrong with it except it has a big hole in it right now, She agreed my car was a very good car but where it was hit, the quarter panel was the problem, welding would have to take place and it would take too much time to fix it. I was told to expect to hear from the claims person later on that day or the following day. I didn't hear anything from anyone. On Friday November 1, 2024, I went to get my car because the collision place, because the lady kept asking me if I wanted to come and get my license plates. On November 1st, I wrote a letter to the CEO of the trucking company that hit me, pleading with her to not let her insurance company total my car and low ball me and if they did, could she find it in her heart to make up the difference and pay the excess of what I receive, to get my car fixed. For I had a total knee surgery coming up on November 26, 2024, which had nothing to do with the accident but the last thing I needed to be worried was car issues, that wasn't my fault. I had also looked up the records on the driver and found out that he had been found guilty of reckless driving and carrying 34,000 pounds overload back in, 2007 and 2008. I said this is who your company hired but I said everyone deserved a second chance but if he's been driving 18 wheeler's for that long, he should have known if he could clear that turn. The CEO never replied to my email but she sent a copy of it to the insurance company. The claims person called me on Monday, November 4, 2024 to let me know the the company sent her the email voicing my concerns. She claimed she hadn't received any information from the collision place, therefore she hadn't totaled anything and her job was to make me whole. She assured me that everything would be settled before my surgery on November 26th. Til this day nothing has been settled. I am 6 weeks post surgery and recovering well, I was just cleared last week to start driving again. I seem to initiate every phone call or text, her response is always, thank you for being patient, I need to gather more information, or I need to check on something and I will get back to you, either later in the day or the following day but that never happens. She did finally call me on December 17, 2024 and said she knew my concern was being able to keep my car, she said that I could but she still had to total it out. She says she doesn't deal with the money part. She would have to send my claim to the total loss department and they would give me a call, "later that day, or the next day." Still no call. I contacted her again a day after Christmas and asked her for my new Adjuster's phone number because I hadn't heard from anyone. Again I was thanked for my patience and was told she would get back to me. She didn't. Last week I called the 800 number and asked who was the new person on my case and was told it was still her and he would send her a note to contact me??? I don't understand the run around, especially since fault was admitted by their insured back on October 14, 2024. Do I report this company to the Ohio or Illinois Department of Insurance for Bad Faith? Or what else can I do? I'm tired.
