My Son (age 18) recently bought a house in Kay County, State of Oklahoma. for the back taxes. $2800.00. After paying at the County Clerks Office, he paid them another visit, so he could advertise in the newspaper to get it legally, they informed him that their was a lein against the property. The woman who owned the house has passed away. DHS took a lien out on the cover medical expenses that they incurred, while she was alive. just over $6500.00. He contacted DHS. They informed that they would not drop the lien. Then she said that their might be a chance. He need to have it appraised. Cost $150.00. It appraised at $5500.00 to $6500.00. It appraised less that what their lein amount to. Contacted her again and she informed him that they would probably not drop the lien.
The house has been abandoned for over three years, don't know if any works, had been vandalized inside and out. The house is probably not insurable. Their is another $500.00 owed on it for Mowing, which he will have to pay. Total he will be out $3300.00, before he even starts to remodel. My Question is. How can someone hold a lien against someone's property, when that person is dead and you cannot collect? as far as we know their has never been an estate settled, or filed in kay county.
