trying to get custody

I will try to make this short. My husband has sole physical custody and joint legal custody of his 12 yr of son. We live in Indiana where the divorce was granted. His son lives in Kentucky with his mom on the agreement of dad gets visitation, unless she wasn't looking out for his best interest. We went to family court in June of his son missing 34 days of school, 22 unexcused. This year so far he's missed 11, 2 unexcused. They are now temporally homeless, living with her friend and he changed schools last al week. He is not allowed to see him cause she's afraid since he has custody he will keep him. But he has never said that. He filed for sole custody last week but she says he has no jurisdiction here even though the divorce and custody was agreed here. Also, he has video of her doing illegal drugs, and one where his son was around it as he is shown in the video. Her husband is in jail until next year for stealing a license plate but has felony charges of drugs and burglary. He's not in a good environment or going to school regularly. What are his chances of gaining custody based on what info he has? What is the name of your state (only U.S. law)? Indiana?
