A former employer has some money of mine in a 401K account. I desperately need this money, but the employer is constantly dodging my attempts to get it. I have filled out and submitted appropriate forms; the first time, they said they never received them, so I asked that they be sent to me again, and they said that they would, although I never received them, depsite 3 requests. I finally got the forms directly from the finance company that handles the 401K plan, and then hand delivered them to the former employer. This was several weeks ago, and the finance company has not received the forms. The former employer does not return my calls; I had a similar situation 3 years ago with same company, and it took several months to get funds owed me... they finally told me that the forms I had filled out were sitting on someones's desk, but this was after several months of lies about them being submitted. I do not trust these people at all from past experience. Any advice as to how to proceed legally will be greatly appreciated.
