I live in an apartment in Houston, Texas. My husband and I have resided here for 4 1/2 years. When we moved here it was a nice place to live. But since we renewed our lease in September 2000, the past 6 months has gone down hill. My husbands truck has been broken into twice, a woman was held up and robbed at gun point in the middle of a Sunday afternoon, the security gates are always broken and unsavory people wander about the property as they please. Not to metion that I recently discovered that I have been having allergy attacks due to the thick black mold we found in the air vents. We have made complaints to the Property Manager (Not in writing) about all that has been going on and the mold in the vents (also not in writing) and they say they can do nothing. I am living in fear of my health and safety. We still have 6 months left on our lease, but want out!!! We contacted the management about leaving, because we feel we have legitimate reasons for wanting out. The manager says she can do nothing, it's all in the computer system and she has no control over it and cannot let us out of our lease. I contacted the Houston Apartment Association, and they told me that due to the circumstances of our wanting to leave, that the apartment manager can let us out of our lease (If she wants to) But still will not. What can I do? Like I said we are living in fear of our health and safety. We have been good tenants, never late on rent and have not broken any lease rules. Do I have any leagal legs to stand on? Your advise is greatly appreciated.

I would hire a lawyer fast and maybe a threatening letter to sue the complex for $1 million dollars for the lack of securiy would make them very agreeable to having you move at no cost to you.
