I rented out my home in California to my sister, her husband, and a friend of theirs. I left some of my property at the house for 5 days after they moved in. I came back to get my things and their was cat feces and urine all over the house. They have a year lease that began 1-31-01. In the lease there is no mention of animals. I knew she had the cats, but she said she would keep them clean and keep the house clean. I am disgusted by the way my house is. I told her that I wanted them all out because they are destroying my house. She said "Good luck trying to get me out, I have a lease and I am paying the rent." I know that is true, but don't I have a way to get them out because of the inhumane conditions that the house is under? Any help would be greatly appreciated.

It will be very diificult since there is no mention of pets in the lease.

Maybe LL will answer since he lives in CALI.

Of course you can always sue your sister hubby and friend for all the damage they have done when they leave, and if they dont pay it will be on their credit report for 10 years, and you could even have their pay attached.

You have plenty of rights..but im not sure how much as of now.

OH PS....anyone in your family near death? If she inherits part of a house or money, after you sue them and get a judgement, you can force them to pay up out of the estate settlemnt.

Can I evict them for the damage or do I have to wait for the lease to be over? I thought that if someone was destroying your property you could evict them.

Unfortuantely you will have see a landlord tenant lawyer on monday, and see what the law is in CA regarding destruction of property, and how to inspect the premisis legally for the purpose of eviction.

You may have to have the lawyer present at the inspection.

Yeah money its gonna cost ya.....but legal fees are TAX deductable against any rental income.

In WA state we have (and probably in CA) a 10 day notice to make corrections.
I don't have in my lease that the tenants can't store garbage on the front door steps, but if I see this I give the a 10 day notice to clean it up or move.

Usually the duties of a tenant (as specified in the state landlord tenant law) will say that the tenant is not to negilgently destroy, deface damage etc.
It'll also say to keep that part of the premises which he occupies in a clean and sanitary condtion.
Pull up from your state govt site a copy of the state landlord/tenant rights and you'll probably find that. Then give them the 10 day notice.

If you see an attorney see a "Real Estate Attorney" who knows the state landlord/tenant laws.
