What is the name of your state (only U.S. law)? NJ

Hey guys,
So here is my story:
I spoke with a dell sales rep(we did this via online chat so I have a record of the entire conversation as I'm sure dell has one as well) and ordered a video card(a computer part). I specifically told the sales rep I needed a video card without a fan, she assured me it had none. Lo and behold a few days later I get a video card WITH a fan. Unfortunately, I was extremely busy and didn't have time to open that box until after 20-ish days.
After which I called up dell for a refund. They said no its outside their 21 day policy. I looked into the policy and it says just that except it also says, "Unless you have a separate arrangement with dell"....so would me saying to the sales rep that I would ONLY buy it if it has no fan be considered a separate arrangment even if its not quite so formal? I mean its pretty retarded that they are forcing me to pay for something I did not agree to buy in the first place...

Thank you in advance!

Not Dell's fault you didn't open it until past their three-week return period. It takes a minute to open a box and check a part. You can't expect them to wait indefinitely. What if it had been six months, a year?

You simply got the wrong part. You didn't check it for at least three weeks.

You're SOL.
