My mother recently passed away from Stage 4 breast cancer at the age of 48. Due to her illness, she never had the opportunity to take my father off as beneficiary of her life insurance policy (he has a gambling addiction). The house is also in my father's name.
We really want to keep the house. It's been in the family for a very long time and has sentimental value. I'm not sure what our options are though. I doubt that my father will sign the house over to anyone else. He's also not paying his debts though, so it's likely to be lost if something isn't done.
We looked into something called a spendthrift trust, but I believe this has to be established in a will of some sort, so that may be a no go.
In short, I would like to gain control of the money that he won't willingly relinquish access to. I'm just not sure if there's anything that CAN be done. I thought someone out there might have some advice.
