I have a friend who called me tonight and told me she's preggers the kicker is she had her tubes tied a couple of yrs ago and the dr told her there is NO WAY she could get PG with the new ways they do the tubals. Before the surgery they left her epidural(sp) in her back from the night before when she had the baby the next morning they got her ready for surgery and numbed her from mid back down to do the tubal surgery well the dr's tested her once to see if she was numb and she told them it kinda tingled on her right side when they did the poke test they told her that was the meds kicking in and thats normal. They started the surgery and cut from the right side to left side......well as it happens she could feel everything on the right side and was in horrible pain and she started freaking out and screaming the surgery staff quickly put something over her mouth and she passed out.

She woke up and the surgery was done and according to her she started shaking very very badly and couldn't control herself. From what I'm assuming a reaction to whatever they gave her to make her pass out? Anyways she wants to know now if there is anything she can do about this? She doesn't beleive in abortion so thats not an option.

Yes, you are correct,...they put her "to sleep" with anesthesia since the epidural was obviously NOT doing the job.

She doesn't beleive in abortion so thats not an option.
Tell her to give the baby up for adoption. There are a lot of wonderful people looking to adopt babies.

THE ONLY form of BC is abstinence. Having tubes tied IS NOT 100% effective 100% of the time.

She DOES NOT NEED TO TALK TO A LAWYER, SO TELL HER NOT TO BOTHER.

Just like shelly said, your friend has no case - tubal ligations have a failure rate of approximately 0.4% - 1%. Even though sterilization is one of the best methods of birth control – in comparison, hormonal pills have a .5% failure rate when used perfectly (which is not even achievable in real life) and a 5% failure rate in the average population.

I'm sure failure rate and complications were explained to your friend prior to the operation. Furthermore, what does getting pregnant have to do with anesthesia complications? If she still had residual feeling after the epidural and was in excruciating pain, it would make sense that they gave her some gas to knock her out completely. Would she have rather been in pain? She may have been shaking b/c she was cold (even though they try to keep patients warm in the OR, it is often extremely cold and pts wake up with the chills) or she might just be one of those people who do not wake up from anesthesia pleasantly.

Do you think that all woman who get pregnant while on the pill, depo or IUD have any legal recourse? If you don't want a baby, don't have sex.

And in the future...She could do what I do...double up! (or even 'tripple' up)

I recieve the depo shot every three months...However, I always use a condom. It not only helps reinforce the depo (NO babies!), but also aids in the prevention of STDs. I don't care if I have been seeing my boyfriend for years. The fact is...I am happy with the two children I have.;)

EDIT: The best advice was given by shellandty:

Tell her to give the baby up for adoption. There are a lot of wonderful people looking to adopt babies
Seeing as abortion is not an option.

I was confsed there for a second when you said:

No, I am a woman...but I keep my own stash of condoms...as every single woman should. That way...the whole "I don't have one" or the break in the 'mood' to go get some is not an issue.;)

Umm, they cut her from the left to the right? Hun, first of all, if they did it the day after the delivery they go through the belly button. How do I know? I had mine the day after delivery, and went home in the morning. The female parts are to high in the belly after delivery to be cutting like you described.

Or you could have done what we did. A tubal after my last c-section, and then hubby had the "snip snip" a couple of years later just to be sure. Insurance paid for ALL of it, so hey I worked out well. My youngest is 7-years-old so It must be working!!! Thank God!!:p

I had two C-sections, first was a crash and the second was recommended. They asked if I wanted a tubal ( I was 22) and said no. I wish that I had said yes.

As far as the husband goes....I got rid of mine about four years ago...I will not be marrying again. I rather 'live in sin' forever than go through that legal mess again!

I think I'm keep'n mine. 22+ years and still going strong. I know I'm one of few lucky ones. I count my blessing's daily. :)

I like the double protection you are using - thats where me and my fiance will be after a few kiddies!

Thanks! I could never remember to take the pill. ( we should have 30 kids by now), hated going to OBGYN for that darn shot in the arrsss one every 3 months. Finally, enough was enough.

Clip clip, snip snip. :D
