Trying To Understand Law

I am trying to understand the laws in the New Mexico area but of course it is never truly that easy and any help would be appreciated

New Mexico Code 40-1-6 Part 2 Section B

Restrictions On Marriage of Minors

"The county clerk shall not issue a marriage license to any person under 16 years of age, and no person authorized by laws of this state to solemnize marriages shall knowingly unite in marriage any person under 16 years of age, unless the children's or family court division of the district court has first authorized the marriage of the person in settlement of proceedings to compel support and establish parentage, or where the female is under the age of consent and is pregnant, and a certified copy of the order is filed with the county clerk."

Hypothetical Scenario: A friend of mine that has a 16 year old girlfriend (17 in a couple months) and she wants to marry him when she turns 18 but she is now pregnant and he is quite a bit older than her. She doesn't want to get him put into jail because she loves him and she knows that in order to keep that from happening she would either have to marry him or not name him on the birth certificate and then wait the time for the statute of limitations to run out so that they can have him put on it via dna testing.

Hypothetical Question: Is the law above going to protect the both of them and keep them together or is it going to tear them apart?
