What is the name of your state (only U.S. law)? Virginia

On August 1, 2009 my 81-year-old father let my ex-girlfriend's son, Ryan (15 yo), and his friend Chris (16 yo), into his house to use the bathroom. Ryan was staying at Chris' house nearby. They stole $1120 out of an unlocked safe in my father's bedroom closet when my dad allowed both of them to use the bathroom in the back of the house unmonitored. They had come by ostensibly to visit me and my girlfriend, but we were at a concert in DC that weekend.

We confronted Ryan at his other friend Cody's house Saturday morning, August 22, after the money was discovered missing and he readily admitted that he knew the money had been taken by Chris and I told him I would have to call the police if the money was not returned immediately. He was very frightened and said that he was not involved, but that he would 'do his best' to return the money by Wednesday, August 26.

He is currently on probation facing 30 days in juvenile detention for drugs and weapons charges at a private school, which expelled him earlier this year, and was very afraid of the consequences, should we call the police. My dad is inclined to wait until Wednesday, August 26, to give him the opportunity to return the money and is also not inclined to tell his mother, Selena, about this until my girlfriend and myself see her for a previously-scheduled dinner party on Thursday, August 27.

My brother, who is a retired Lt. of the Newport News Police Dept. of 19 years, has said we should file the report by phone and then dismiss the charges if he does pay back the money in full, which I currently feel is unlikely due the passage of over three weeks time since the crime was committed. Please advise. Thanks!

I guess by now the money is gone .

Grand should file the report .
