TX LL breach and "Cloud Title"

Our contract states that the LL would professionally repair the carpeting. She has not done so after 7 1/2 mos and broker says LL told her she was not going to. Does this constitute "Breach of Contract"?

If LL did not disclose that she was behind on mortgage and going into default just as we gave a deposit on the home and that there are issues with ownership of the home that she didn't disclose before we agreed to the lease can we seek from her a termination of the lease.

If LL supplied wrong remit to address on contract can she assess excessive late fees for payments? she is trying to assess $25 daily when lease says $25 initial then $5 daily after that. and she handwrote the remit to address herself.

We want to terminate this lease the most efficient and less damaging way as possible. I have all the public record facts that show "Cloud Title". Your assistance is greatly appreciated.
