What is the name of your state (only U.S. law)? Teaxs


I recently seperated with my spouse and we have no joint accounts.
While beeing out of town she went into my residence and grab theck book and paid her AMEX bill $700.00(unauthorized ACH). Once again we have no joint accts. I'm aware I can get the funds back, but what kind of legal charges can i use or prosecute with, and if her first offense for any criminal or civil charges will I be able file a felony charge against her?

You can't file anything against her - but you can report the matter to the police and the DA will then decide whether or not to file charges. Having said that..can you prove you didn't give her permission?

Did she forge your signature?

She has moved out of the house (October 28th, and the charge was on Nov 19th)and taken all her and the kids belongings.
Her mail was fowarded 3 weeks before this incident.
No papers have been filed
She has never used my account to pay her bills.

File a police report and then file a fraud claim with your bank. That is all you can do.

Oh... and change the locks:cool:

I had the exact same thing happen, except it was a Verizon bill. The fact that you aren't legally seperated means nothing. If you can prove she moved out and is not on the account, call the police. They will take it from there. It is theft!
