What is the name of your state? Ohio

A medical company named Medco charged my debit card with sixty dollars worth of unauthorized charges for my moms medication. they lied and said they had a signed order form in order to do this. I want to sue for this action. The result was I cant get a vital medication for my severe case of hypertension, my mother went to the hospital all my bills will be late and I couldnt buy anything for our household. The hospital almost admitted me. MEDCO lied and said they put the money back, but didnt. They also admitted that there was no signiture or order form that came with a medication re-fill. I understand that small claims may only award $1000 and double interests, does this case warrant more? please advise

Sue in small claims for the $60.

Rather than going back and forth on the phone with this MEDCO company to get your money returned your FIRST phone call for the UNAUTHORIZED charges must be to YOUR BANK !
Why did you not call them ?? They can reverse the charges, they'll do an investigation, and you would have to probably provide proof to back up your story.

Suing over $60 ?? You probably can't get damages, but you might. It will probably cost you a lot more than $60 to pursue a lawsuit. Call your state attorney general's office and notify them of this fraud (because that's what it truly is) and see if they can help you out.

Get PROOF, in WRITING from the hospital that nothing was authorized.

What Was Done

I did notify the bank and filled out the proper paperwork to reverse the charge.I'm a para-legal so I know how to do the footwork. I also found seventeen pages of past customer complaints about Medco on one website. As far as customer service, they have a bunch of liers on the pay roll. I also made a weeks worth of calls to Medco and heard more lies. Thanx for the tip on the attorney general I will follow up. The reason I ASKED ABOUT A SUIT IS BECAUSE I have severe hypertension and am going with no medication which in my case is a life threatening situation. Thanx for the response. Mistakes are mistakes but criminal is criminal.

Have you tried calling your doctor, explaining the problem and see if he/she can give you some sample packets of your medication to get you thru ??? Letting your blood pressure go out of control is just a terrible risk and you're not supposed to just stop that stuff, right ??

Yes, my blood pressure was so bad that my doctor gave a months worth of one of the meds. Medco sure didn't help my situation any.
