unauthorized funds debited from checking acct

a pymt was authorized for check#2692 over the phone with a banking company with whom I have a loan. there was some confusion on the lenders side with the payment not being posted in their system initially. i made mult calls to verify the check# and that this had been appl to my acct and the check# was given during each phone call. the bottome line is they withdrew the pymt with the approved check#2692 and they also debited my account with a #999 check#(which was not authorized). there are overdraft chgs on my checking acct as a result of this dupl debit. they are telling me to send documentation of the dupl debit even though it is in their system and documentation of the over drafts and they will mail me a check. is there some type of timely manner in which they have to refund me this amount? can't they electronically deposit the amt the same way they removed it? I live in Iowa.

We had a problem similar to that. To my knowledge there is no timely manner to which they have to reimburse you. And i'm pretty sure they can't just electronically deposit the money into your acct, because it was a check, and not a debit or credit card. We contacted our bank and had them send us a copy of the telecheck that was in question. Sometimes the bank will drop any overdraft fees due to that check if it is questionable debit from your acct. You can also dispute that check with your bank and they will do their own investigation on it. We knew something was wrong with ours because they used a check number that my wife had written out previously to another business. That was our proof. Because ours happened over the internet we contacted an internet fraud site, gave them the details, and let them handle it. They contacted our local police fraud unit and from there, the police contacted us and began investigating it. Since yours is a loan payment. In my opinion, i would get that copy of both checks from the bank. Send those, along with copies of all overdraft charges and any fees from bounced checks to the loan institution. Find out if they have on their records that they called you and had ck#999 authorized. Most payments over the phone are recorded, or at least logged down. Ask them to reimburse you for any charges incurred as a result of their error (let them know nicely that you plan to pursue this with your bank, and possibly with the police...a little gentle pressure on their backside sometimes helps speed things along). Or just contact your local police dept. and see what they say they can do. There are a couple of options. Hope this helps some
