Unborn child rights???

Hello everyone-

I hope that someone can help me. I have been married for just under 3 months. I am 16 weeks pregnant with husbands child. I plan to begin divorce proceedings this Monday.

Problem: Husband wants custody of unborn child.

This is an insane request, in my opinion, as he has shown no interest in the pregnancy nor has he moved into my home with me as he promised before we were married. This is purely a power play.

Can someone PLEASE offer me some advice? I want to have as much info on this topic as possible to take to the table. I have searched high and low for more info on unborn child custody, but have not found much.

Just a question?
Are you sure that he is the father?
In most states if he can proof that he is the biological father or if you put his name on the B/C as the father than he has as much legal rights to the child as you do.
If any questions, get a DNA test..before the child is born.

Sounds like a bizarre situation at best, but you obviously have physical custody for the next several months. Once the cherub's here though, dad does have equal rights and obligations to him/her.
