we recently sold our house in California. Before we put it on the market, we called our mortgage company to ask for a closing balance. We based the sale of our house on this balance.
When the sale went to escrow, we discovered that the mortgage company had added on almost $10,000 in deferred interest.
When we enquired about this and asked where we could view their legal right to do this, we were told that "this information is not available to the public."
Also, we stated that we'd sold our house according to what they had given us as a closing balance and because of this, we now OWED money, instead of gaining any. The manager of the company asked us "did we have a recording of this telephone conversation?"
Of course we hadn't. Is there anything we can do??

Consult a lawyer on this -- it may be very illegal and a letter from the lawyer might solve the problem, real fast.
