I was at a school oriented football game with a few of my friends just relaxing and watching the game when our school cop called me over to talk to him. He then began questioning if i had been drinking and i told him no. They harassed me for a long time then finally gave me a breathalyzer of which i blew a 0.016 - I know that listerine and some cough medicines have as much as 26% alcohol in them. Will this defense work? He arrested me before i even blew the breathalyzer saying that he could tell i was intoxicated. Obviously at 0.016 i was not intoxicated. The cops in this town are real dicks and i live in a real richy richy little town so the cops have nothing better to do.

I dont want to get into trouble. and if i plead guilty i might go to jail and if not i'll definitely have to go to a 4 month long rehab clinic 3x a week. which i do not want to do

Will the listerine or cough syrup medicine work if i plead not guilty? I mean that blood alcohol concentration is so ridiculously low i couldn't believe it.

Please help me.. I have court this wednesday

i had a few beers, but i never admitted anything to them.. I'm pleading not guilty no matter what. Why does it matter what i drank?

It matters because you're lying, you idiot.

You were drinking, you're underage, you broke the law. Grow up and face the consequences instead of acting like a child and trying to lie your way out of it.

I guarantee you, the judge is going to LAUGH at you if you say "oh, it was the listerine."

For instance if you drank 100% proof of Grandpa's homemade cider 10 minutes before the blow test and was 4'8 and weighed 85 lbs, the results would be different from say if you drank 1 wine cooler 6 hours before the football game and was 6'3 and weighed 265 lbs.
So, since you do not fully understand how defense law works and wish to question my legal approach, all I can say is good luck to you and your poor rich parents.
