What is the name of your state (only U.S. law)? Pennsylvania

My daughter was in a dorm suite at college she was in a seperate room sleeping, the other suite mates were in the common are of their suite drinking the police were called and they pulled all of them out of the rooms too and charged them with underage because they said their eyes were glassy what are our chances of getting this dropped? No BAC was taken.

An underage consumption would be followed up by a detailed police report, and if the child was under the age of 18 then she/he would be escorted to the police station if deemed intoxicated and a parent would be contacted. I'm not sure how old your daughter is, but if she was truly not intoxicated then the police report will have to show this. Cops typically do not lie just to get arrests. If the daughter was asleep in her own room, and the cops walked in or forced their way in without being let in, then she simply can have it thrown out due to illegal entry. However, if the policeman observed alcohol on her breath and there is no legitimate reason to think otherwise she will not be getting out of it..
