What is the name of your state? Pennsylvania
I was issued an underage drinking citation and I am 20 years old. I just wanted to know when this information shows up on your background check. I work at a Pharmacy and to become a technician you have to take a lot of tests and then they perform a background check. I have not been to court yet, and I am not scheduled to go for another month. Also I was accepted into a pharmacy school, is this going to affect me?

(When your saying underage drinking I am guess not a dui but a underage drinking charge/MIP.) It is possible DA will reduce it, if its your first offense. If not plead for mercy to judge. You might have to do some community service, pay some fines but wont go on your record. Best of Luck,

The best thing to do is be truthful in any/all applications, it is best to be honest and have 'them' (emploer/school/college..etc.) know that THIS was a bad choice made by you, and that you have(or soon will) "pay" for it, ie: community service- fine(s)- etc. etc... Whatever the courts impose on you. You do know that your license WILL be taken... ? You are under the legal age--(21) and there is ZERO TOLERANCE for this.

Serious Consequences for DUI

If you're arrested for DUI, the police will ask you to take a breath, blood, or urine test. If you're BAC is .02% or higher, and you are convicted of DUI, you can expect:

Up to one year driver's license suspension
Drug and alcohol evaluation
Fines (up to $500 for a first offense). Court costs, and restitution
To complete state-approved alcohol Highway Safety Program, if ordered by the court.
If you refuse to take a test, your driving privilege will be suspended for one year, even if you win your DUI case.

If you're under 18 (Juvenile DUI), you may also have a juvenile complaint filed against you within 5 days, and may be adjudicated delinquent. Your parents will be notified of your arrest.
If you're 18-20 (Minor DUI), you may be ordered to Accelerated Rehabilitative Dis-position Program (ARD) if you qualify. If you don't qualify, you will be sentenced to 48 hours in jail.
A DUI arrest stays on your record for seven years. That's a long time. If you're convict-ed more than once, the fines, suspensions, and jail time all increase.

sorry that I did not make what I wrote more clear. I did not get a DUI, I was not driving and we were not in a car. I just posted my question here because I thought that this category was most appropriate, and I saw a previous poster write about an underage drinking citation also. I just wanted to know if this would show up on a background check even though I have not been to court yet. All that I have received is a green slip of paper that says that I promise to go to court on a certain date.

Still... get some FREE legal advice (if neccesary- never hurts to kniow more..- )... and follow through with what "magic" suggested.

PLUS... do not repeat this 'bad choice' again.

From Pennsylvania statutes:

PURCHASE, CONSUMPTION, POSSESSION OR TRANSPORTATION OF LIQUOR OR MALT OR BREWED BEVERAGES BY A MINOR
Section 6308 of the Pennsylvania Crimes Code (Title 18)

A person commits a summary offense if he/she, being less than 21 years of age, attempts to purchase, purchases, consumes, possesses or knowingly and intentionally transports any liquor or malt or brewed beverages.

(First offense) It is punishable by a fine up to $300 and/or jail time up to 90 days, loss of license for 90 days.


If it were me, I would consult with an attorney to see what they may be able to do for you.

Looks like you can get a DUI in this state for blowing a .02. That's where DUI law is going. If in the officer's judgement, alchohol is a potential contributing factor, a DUI charge can be submitted whether one blows above the "legal limit" or not.

MOral of the story: Don't go near a car if you've had anyting to drink.

How many more people will drive under the false sense of security that they've only had a couple, and not enough to be over the "legal limit". The legal limit should be zero. Anything above that is misleading.

I agree, I've been designated driver so many times. Occasionally the drinker's I have toted around think they are just fine to drive. Yeah, . . . . . right! They must have been impaired or something.... :D

The "legal limit" 0.08 is unfair to all of us, victims of DUI and those arrested for DUI. One good thing is a new commercial on TV that says, "buzzed driving is the same as drunk driving". But I doubt anyone will listen, until they get caught. It all becomes much more clear after that.
