I was at a party and the police came. I had not been drinking, but I had a drink of a friend's energy drink. When the cops asked if I had been drinking, I told them my story. I also had said that if there was something in the drink, then I guess I would have been drinking. The officer didn't ask for any identification, and said it wasn't necessary when I offered. I wasn't given a field sobriety test nor a breathalizer, and I was permitted to drive away. This is my first offense and I am incrediby scared. I was not allowed to leave the premises nor was I given my rights. Does ANYONE have any advice for me. I would really appriciate it.
Thanks. I am from Kansas.

I am a law school graduate. What I offer is mere information, not to be construed as forming an attorney client relationship.

Your story doesn't make sense. You first state you were allowed to leave, nothing taken, no ID shown, no ticket, no arrest. Then you said you weren't allowed to leave.

Basically, if no field test and no arrest and no video, no case. Take it to court -- get a criminal defense attorney and have them fight it in court (should be no sweat).

Try attorneypages.com or contact your state bar association by calling 411 or looking it up under legal services in the yellow pages.

Hope this helps.

I was not allowed to leave. The police had everyone in the hall way, and took groups of us off into different places to ask questions. If I was allowed to leave, believe me, I would have! :)
