My 18 year old son was stopped in a nearby small town for going 46 in a 30 mph zone. The officer smelled alcohol. He had drank a 40 oz malt liquor two hours earlier. He passed the field tests but his breath test was 0.07. The underage DUI range in Arkansas is 0.02 – 0.09, so he was charged with DUI. We called and his fine should be $700 with his license suspended for 90 days, I believe he can get a hardship provision to drive to and from work. I just don’t see how an attorney can be cost effective in this situation, when it will cost $500 to $1000 to hire one and I can’t see the case getting thrown out. I’m no attorney, but I know a few people who have been charged with DWI and have asked around and researched the topic and I can’t see anything improperly done with the situation by the law enforcement people. Can he plead Nolo Contendere in a DUI? Couldn’t he just ask for leniency and do about as good as hiring an attorney?
