Some pictures from an off campus party and an off campus fraternity party were posted on facebook and were viewed by university officials. Some of the pictures show students who are underage holding beer bottles. Some pictures are just of students with red cups in thier hands. The pictures were from a few months ago but the university is trying to charge the fraternity with furnishing minors with alcohol and underage drinking. Since these pictures were from so long ago and you cannot prove that anyone had actually drank any alcohol because nobody was charged at the time, is there real legal action they can take against the fraternity and/or the people involved? What would a good defence be to argue this case?

That you are disbanding the fraternity and moving to a new college.

The mere possession of the liquor, if proven, is enough to put you out.

You seem to think that the university could not take action "Since these pictures were from so long ago" even though you said "The pictures were from a few months ago".

Months is not a long time in legal circles. Years is along time. I think the only reason the police haven't been arresting your frat brothers is because the university would prefer to keep this from getting too much publicity.

Get a local lawyer and put together an action plan for how you plan to conduct yourselves while on probation - no alcohol or drugs, non-alcoholic rush parties, community service, etc. If you can say "mistakes may have been made, but here is how we can be a constructive part of greek life on campus", then you mught have a chance.

It all depends on your past history and how quickly your National will cave in to university demands in order to reduce their exposure. That's why a chapter layer may be netter than a national lawyer.

I feel for you. Frat life and the prevalence of camera phones has changed a lot over the last 20-30 years.
