my daughter recently hurt her knee at work. Just got up from her desk, that's all. Dr. told her to sit with knee propped up, but would prefer that she didn't drive.Duh? 25 miles from work. Since she didn't fall, run into anything, etc. except twist it, is she entitled to worker's comp. she did hurt the same knee 7 years ago and wore a brace for awhile. This Dr. says it might be a miniscus tear. had an x-ray and is scheduled for an mri. she might be off for a while because she can't just sit all day.help if you can.

She is certainly entitled to apply for workers comp. Whether she will get it or not is going to be based on factors not available to us here. The fact that she hurt the same knee previously is not in her favor. But by all means, she should apply.

If it is determined that it is not a work related claim and therefore not covered under workers comp, her medical bills will be payable under the regular group health insurance policy, and if her employer has a short term disability plan (PA does not require them, but many employers offer them voluntarily) she would very likely be able to receive some wage replacement there. It's one or the other, though; she EITHER gets workers comp or coverage under the group health/disability plans.

thanks for the info. she has no insurance at work, in fact no benefits at all. she has gateway ins.( medical ins).you know how that goes. this happened on sat. and just had x-ray today, mri on fri. lord knows when or if she'll see an ortho. surgeon.

As I said, she can apply for workers comp, but before they will pay it will have to be determined that it was caused by something in the work environment. The fact that it happened at work does not necessarily mean that it was caused by work.

BTW, your post is headed Unemployment. Unemployment and workers comp are two entirely different things, available for entirely different reasons. Given the information in your post, she would have NO cause to apply for unemployment.
