What is the name of your state (only U.S. law)? NJ

My NJ unemplyment claim benefit year is being calculated from 10/1/08 - 9/30/09. I worked on 9/28, 9/29, 9/30, but was paid for these day on 10/4/09. Unemployment is stating that the base year wages are calculated by the dates I was paid, not the dates I worked. So they are not counting this last week of days worked from 9/28 - 9/30. They say it's a state tax guideline, but no one can tell me where I can find this guideline in writing. I checked the Unemployment handbook and NJ Department of Labor website and cannot find anything that says this. Is this true?
