I injured myself at work lifting a Alzheimer resident from their wheelchair back in October 07. I since have been told that my employer can no longer offer me transitional work - They can offer me full duty or and heres the gliche "a leave of absense", but can only return to work with a discharge to full duty clearance from a doctor.
WC adjuster has not reinstated my compensation of payment for loss of wages nor have I been recognized as having any disability. They are saying that my neck injury was 'pre-existing (even though I was discharged and capable to go work from a minor car rearending before I worked there). They are recognizing the lower back injury that also occured with the resident, yet to date (since the denial in Feb) they stopped the partial payment of loss of wages.
What can I do to get that reinstated?
I have applied for unemployment and recieved a letter that says I could be denied due to "no good cause" of leaving". I have not agreed to leave nor have I agreed to take a leave of absence, yet if I return to work there is no transitional work for me. " Sedintary" work was recommended by the Company doctor yet my employer has chosen to not offer me office work such as filing or answering phones, even though I am skilled in both). , They wanted me to sign the letter that offered me all of this and I have refused, as I am not on leave of absence, I am layed off due to lack of transitional work.
How can I keep my unemployement?
