I worked at a high-volume, high-stress call center for nearly 4 years. As I understand it, I was given immediate termination nearly 3 weeks ago for making an obscene hand gesture directed at no one.

I thought that I'd be reinstated, so I delayed roughly a week before applying for unemployment insurance. Today, I was told that, provided my last employer does not fight the application, an unemployment check should be mailed on July 20th. I understand that if my claim is denied, I have the right to appeal the denial. I also understand that my appeal might be denied. Would you recommend that I contact an attorney? If so, at what point during this process, should a contact an attorney (now, wait until I get information in the mail about my claim for unemployment insurance, if it is denied - wait until I get a reply to an appeal, etc.)

I understand that I made a mistake. I learned from it. I've had several interviews but I've received no job offer yet. I understand that my boss had every legal right to fire me, but I still think that I'm entitled to unemployment insurance.

I think that this is all of the information that you need. Again, please give me any advice concerning if and when to contact an attorney for issues concerning my desire to be approved for unemployment insurance. Thanks.

I think an attorney would be an unnecessary expense at this point. At least the initial hearings when an employer contests are specifically set up so that an attorney would not be needed.

As I recall, you thought you deserved severance and vacation time, too. For someone who claims to have learned his lesson, you seem to have something of an entitlement mentality.

I think your claim is going to get denied, if your former employer tries to fight it. You were fired for cause. Hiring an attorney is only going to cost you money that you probably don't have (being unemployed) and get you nothing.
I agree. Your case is not very complex and I would feel comfortable saying you can work the initial appeal process if need be without a lawyer anyway.

If it needs to go further than that, a lawyer would be a sound option... but given the amount of money at stake vs. the cost of the lawyer... it does not make economic sense.

4 weeks is not a long time to find a new job.

Keep up the struggle and work hard.

Besides, you haven't even had your first review yet. ;)

It is not an issue of “entitlement mentality”. Also, I learned my lesson. Now that I've said that, the following is my main point:

As long as it is cost effective and I have a reasonable chance of succeeding, I am still going to go after everything that I might have the remotest chance of getting. I will do it in a legal fashion. Above all, I will pursue it in a calm, cool, collected and professional manner.

I'm not saying don't pursue it. I'm saying that whether you "deserve" UI is subjective and not everyone might agree with you.
