In July, 2000 my boyfriend and I wanted to purchase a timeshare property in Arizona. On the Purchase Proposal, we both filled out the information and signed the proposal (I was listed as the primary buyer). I made the down payment. On the Promissory Note, his is the only signature. He is the only one listed on the title. All of the payments were taken out of my checking account. We just received a copy of the documents where my name, signature, and information were crossed out and his was left alone. (I had wanted the property and he did not. He was only wanting to help me purchase the property and this was clearly stated several times at the time of signing.) The unauthorized and uninitialed changes to the Purchase Proposal have been discovered due to follow-up on collections activities on the note. Until now, we had both been told that he would not be the only one on the property and that by his signing a quit-claim deed he would be released from the property and I would be the only one on the title and note. I am the only one that has made any performance (payments) regarding this "purchase". Is this a voidable contract or even an enforceable contract? What can be done regarding my financial loss and his damaged credit?
