My daughter lives in Wa state and I live in Texas. My ex and I have been divorced for 4 yrs. In April of 2000, I recieved a modification notice. On it I was told I had 60 days to return my written answer or the courts could enter a default order. I returned my paper work in a timely order and never heard anything as to the order being put into place. The Child support office continued to send me monthly bills for $25. April of 2001 I recieved a letter from the child support office letting me know that I am in arrears since last april becuase the court had put in a default order. For $210 a month for the last 12 months..Ouch. I am not employed and have not been employed since last may (2000)Is this fair/legal? Is there a way I can find out why a default order was put against me when I had turned in my paperwork on time? And they are wanting me to make $365 a month payments to pay this back support? Can I change that for the reason of unemployment?
I am in Texas and cant afford a lawyer to fight this and I cant afford to make these payments. Any help would be greatly appreciated.

How old is your child how much do you owe?
what is your education and skills? how much is your current obligation not including arrears? you have the option to file for modification in the appropiate court

My daughter is 12, I owe $3015 {lawyer fees included which I have no problem paying) I have a high school education. My current is $210. Ok if I can file in the appropriate court, who do I contact (roughly)and do I have to have a lawer becuase I am not in Wa? Thanks for your reply.

You should have sent your reply "certified, return receipt requested" At this time you have to file a petition to vacate your default, present acceptable proof you timely replied. You can also seek a modification based on your actual income
