Hello, I'm from Arkansas and about a month ago I was evicted from a place after almost 4 years and the reason for eviction was that I had a load of chat brought in to fix the driveway due to water washing it out. The cost of the chat was a meager 15 dollars and my dad charged only 10 dollars to bring his tractor and blade over to my house and spread the chat. When rent was due I simply held out the cost of 25 dollars. Grant it that I had told my landlord of the problem and he continued telling me he would look at it.. He lives only down the road 2 houses but never made an effort the correct the problem. Now last night I was served papers that I was being sued for nearly 2000 dollars for several different reasons. trees were cut down by the cable contractors and they were obviously sentimental trees and he was told by the workers that I gave them permission to cut them down. Also the trailer had been built onto and it leaked badly. now he is charging that the airconditioner that was left in the window by him had leaked and rotted the floor and that my ice maker had leaked and rotted the floor in the kitchen.. I never used his air con because I had my own which was put in the trailer in the spring after the cold. I did many things to improve the residence and never not once paid my rent late or complained about all the repair that needed to be done.. even when i had all my pans and pots sitting under SO MANY LEAKS that i ran out of pots and pans to catch all the water.. He told me that he would be down too fix the roof several times but nevered showed.. It was my father in fact who had to fix them..My father will testify to the fact that he did all the repair to the place just to keep the landlord off my back.... anyway folks, I could go on and on but just want to know if he has a legitimate claim here.. bottom line is i was evicted due to failure to pay rent of the 25 dollars for chat.but in my eyes i did pay it and he accepted it when he accepted the rent check. not one word was said about it at the time i paid the rent.. not until the following morning and then that same night a deputy filed the eviction. Angry and if anyone can relate to this please pitch something in......thankyou

First, we need to clear up a misconception you have about the 'eviction process'. Based on your post, it sounds like you were NOT evicted. You were given a notice to vacate by the landlord, which you could have challenged and possibly stayed in your location. Instead you VOLUNTARILY vacated the premises upon request of the landlord.

And now your 'former' landlord has decided to sue you for alleged damage claims. Both of you will be able to present your cases to the court. The landlord will have the burden of proving that YOU caused these damages and the cost of these damages.
