Tx. Can a company that you travel and work for fire you over phone. Not being there or knowing both sides on what happened? Boss heard called fired us girls..
But when boys did same thing and he saw them. They didn't even get disciplined. Just asked girl what she do to deserve it?

Explain please.

Firing you over the phone is legal. The boss does not have to be present to see what happened or ask for both sides of the story.

It is not inherently illegal to treat different employees differently for the same offense. Do you have any actual evidence that the women were treated differently than the men BECAUSE they were women?

Yes. There's witnesses. And on multiple did things. Drinking at work. Woman fired. . 6 men did same thing. Blind eye turned.
Only people to be fired were women.

After 44 years in management it amazes me that people now a days don’t realize they are ‘at will’ (unless legally different) employment and cry over feeling they have been treated unfairly when getting the boot because they failed to get along in the play pen so to speak. If they have legal ground to stand on with their complaint that’s a different matter.

Bring the witnesses forward. When it comes to ratting on your fellow co-workers there usually will be no witnesses. You want management to do all the dirty work and pull a rabbit out of the hat. Management will act where the is evidence that warrants it.

There could be 1000 reasons why the women were fired and not the men, and 995 of those reasons would be legal. Without knowing a great deal more about the specific incidents, the company policies, the various statuses of the men and the women involved including their past histories, relative position, previous incidents, and no doubt a half dozen other factors, no one can say for certain that what happened was or was not illegal.

We have no knowledge of anything that happened at your place of employment. If you have been fired and believe you, as a female, were fired for something for which male employees have not been fired, then you should be speaking with a local employment law attorney.

While waiting to decide whether to consult with an attorney and/or file a complaint, you should file for unemployment. Depending on what the facts are (e.g., length of employment) and what your employer says happened that led to your job termination, you could qualify for benefits.

I would be willing to bet there was some sort of company policy forbidding the use of alcohol/drinking on the job. If this was the case, the woman would not be likely to qualify for unemployment without a lot of real fancy footwork regarding appeals, even if others had done so without being fired. If the women knew or suspected they might be fired, that'd be hard to get approved. If "everybody else was doing it" and they didn't have any expectation they would be fired for doing it, they might be approved for unemployment. It's always worth it to apply, anyway.

What company in the entire world WOULD NOT have have a policy forbidding employees drinking or drug use on the job? This is just common sense unless your job is a wine taster. They knowingly violated the rules and got caught. Rationalization that others ”got away with it” won’t work as a defense. If management unfairly condoned this behavior for some and not others present the evidence to the administrative law judge at the hearing.

Also, there are fuzzy areas. If you travel for business and have a drink - maybe visiting a trade show, corporate retreat, etc. As well as company events that include alcohol, such as all-hands meetings, celebrations, etc.

You are correct. I should have clarified that I’m talking about employees that can cause grave repercussions to themselves, the company and others if impaired on the job. I am a soon to be an ex front line supervisor in a power plant. If the “girls or boys” travel and have a few cocktails on the airplane or at a social gathering for work, not a problem with me unless the company has reasons to forbid it. It has to be kept in mind that when you are traveling, socializing or whatever for the company you are representing the company and getting paid to do that. If the rule is no drinking during company travel on paid time that is exactly what it means.
