In the last 5 years I have applied for 6 different positions at this local college. I always got a letter stating that I was qualified but do to the amount of applicants you were not selected for interview, until the last position I applied for I never received anything and found out later they filled the position. The Human Resources Manager at the college told two people whom are friends of mine that work at the college "that I will never work at the college period".

After appling for the last position and not receiving a letter or anything from the college, and after finding out the position was filled, I made numerous calls to the Human Resources Manager to find out why I was not consider for the last position, but he will not return my calls. He did make a statement to friends of mine that work there that I will never work at the college.

Because of the non-response I sent emails to the Chancellor, and board of trustess to see if they could help me with this situation. Again no response.
I am 49 years old and just want fair treatement like the other applicants

You do not have a guaranteed right to work at the local college no matter how much you want to and no matter how qualified you may be.

Unless you have a VALID reason to believe that you have been singled out BECAUSE OF your race, religion, national origin, gender, disability, pregnancy or because you are over 40, you have no case. You have absolutely no way of knowing how qualified the people they have selected are, or how many applicants they received.

It's not impossible that the HR manager may have decided he is never going to hire you, because you've been so persistant in trying to force yourself into a position that he's gotten fed up with you. And that's legal.

And it's also possible that the HR manager has had experience with your spelling, grammar and punctuation and decided you don't belong in the post-secondary environment. :rolleyes:

All the people that were hired are half my age.

Geeez man, grow up. I'm 50 and I've NEVER had a problem, even before I purchased the company.

You were deemed not qualified,period. So sue God for giving you the inability to recognize that! :rolleyes:

I want to know how to get fair treatment from them, It is not fair to me or anyone to be told in writing that you are qualified, and have a Human Resources Manager say you will never work here, and not give any reasons why.

They are already saying I am qualified for the positions, if I am qualified according to them then I should have been afforded the same opportunities as the other applicants, which is not happening. The should be obligated to inform to the applicants why they were not considered.

I still feel that age is the issue in this, only because all those hired are very young.

The fact that the ones hired were younger than you is not, in itself, proof that you were not hired because of your age.

However, if you feel that this is the case, you are free to file a complaint with the EEOC and/or your state discrimination board.
