I ordered a Computer System from a company on 10/5/2000. The system was supposed to ship out in 2-3 weeks. It has now been over 10 weeks and they still ave not shipped it to me. They have sent me e-mails 4-5 times that say it will ship by the end of the current week. I was wondering if there was any legal action that could be taken against them because of their inability to fulfill the original purchase agreement or because of their misleading contacts with me at later dates.

Computer System was not sent either

I had the exact same problem, I wonder if we're referring to the same company (Axis Systems).
I ordered on 10/16/00, the money was deducted from my account IMMEDIATELY, and I was told that the system would be built in 10 to 15 business days, and shipped by 2 day mail.
Up until 12/6/00, they were still LYING about when the system would be prepared and shipped.
My hunch is that they had not even STARTED working on my computer.
So, in other words, they were using my money as some sort of interest free loan to carry them through, meanwhile, I'm paying interest because it was funded through my credit card.
I am going to file suit against this company, because I lost a lot of time, and potential business due to their delay and lack of honesty.
I asked for a full refund last week on the 6th, and they had the nerve to tell me that I would be credited in 1 to 2 billing cycles. THATS ONE TO TWO MONTHS- FOR A TOTAL OF AT LEAST 3 MONTHS OF MY TIME AND MONEY!!!
My history leads me to believe it will actually be more than that, but please, be smart and dispute the charges on your credit card while you still have time to do so.
After that dispute period ends, theres not going to be much your credit card company can do.
