My son was involved in an accident in Arkansas with personal injuries to him and his passenger. The driver of the other vehicle was sited at the scene and produced proof of insurance to the officer. His insurance carrier had cancelled his auto insurance 12 days prior. My son is carrying only basic liabilty with no coverage for uninsured/underinsured motorist.
The accident totalled the car my son was driving and sent both my son and his passenger to the hospital.
What steps do we need to take to get his car replaced, hospital bills paid, etc.?

My response:

You're son is out of luck. Your son should have been carrying more insurance than mere "liability". This is the purpose of insurance, and saving money in the short term is going to cost him big bucks in the long run.

Even if you sue the other driver, all you might obtain is a judgment - - and one that won't be paid.

The end result of all this is that your son will be paying for his hospital bills. Additionally, the only winner in this will be your son's passenger who will be making a claim against your son and your son's liability policy.

This is one of life's "hard pills to swallow".
