I am being threatened by the Maryland Automobile Insurance Fund for an accident I was involved in while driving uninsured in 1998. Am I leagally bound to make this restution to MAIF?

My response:

Yes, you are. They could sue you and garnish your wages, empty your bank accounts, or take any property you own. However, there is a bright side to all this. Like anything else, claims for money are negotiable, and the terms of payment are likewise negotiable. Try to negotiate a lower principle amount owed; for example, if they want $5,000.,00 from you, offer $2,000.00, to be paid at $100.00 per month. Then, they may come back with a counteroffer but, at least it won't be for the full $5,000.00.

So, this could turn out to be a win-win situation. Write back and let us know how the negotiations turn out.

were you at fault and they paid a claim for your car?

Or were you NOT at fault and they paid a fraudulant claim to the other driver?

Who got the money?

My response:

No, no, Peter. Maryland Insurance is the insurance company for the other driver. Since our writer had no insurance, Maryland paid their insured under the "Uninsured Motorist" provisions of their insured's policy. Now, Maryland Insurance has subrogated their insured's claims, and are trying to collect what they paid to their insured, from our writer.

I thought that Maryland Automobile Insurance Fund was funded by a portion of the premium paid by all insured drivers in Maryland. If that's the case, wouldn't they be asking me to pay for a claim for which they already have funds for? I thought that that the fund was created to pay for such cases as mine. I know it is not fair to the insured driver to pay these funds, but I thought this is what the fund was set-up for.
